Wrongful Death Lawyers

What Is a Wrongful Death Lawsuit?

The term “wrongful death” is defined as when a person is killed due to the negligence or misconduct of another person, company or entity.  A “wrongful death lawsuit” claims that the person who died was killed as a result of the negligence (or other liability) on the part of the defendant, and that the surviving dependents or beneficiaries are entitled to monetary damages to compensate for their loss.

Some of the most common situations which result in a wrongful death include:

  • Automobile or airplane accidents
  • Exposure to hazardous conditions or substances in the workplace
  • Criminal behavior
  • Death during a supervised activity
  • Workplace injury that lead to death

A wrongful death case is different from other types of liability cases because a wrongful death case is filed by the relatives and beneficiaries of the injured party instead of the injured party themselves.  The ability to file a wrongful death lawsuit is a relatively new concept in the history of law.  Previously, the reasoning was that the claim died with the victim and there was no way to compensate that person for their damages.

Why Should You Talk to a Lawyer about Your Wrongful Death Case?

Over the years, individual states including Oregon have passed "wrongful death statutes" that provide compensation to those who care about the person who died and are affected by their death.  Because each state has their own statues around wrongful death cases, it’s especially important to talk to an experienced lawyer about your case as soon as possible.

Studies show that 40% of adult Americans don’t have life insurance whatsoever and over 50 million people in the US don’t have adequate life insurance. Other studies show that less than 25% of people whose spouse had life insurance felt that life insurance was adequate to meet their needs.  As a result, spouses and children have had to drastically change their lifestyles.  These changes often include working longer hours, taking on a second job, borrowing money, living off of savings or investment accounts, and/or selling their home to move into less expensive housing.  All of these stressful changes are in addition to coping with the loss of a loved one.
